The Siskiyou County Board of Supervisors welcomes you to this meeting. This agenda contains a brief general description of each item to be considered. If you wish to speak on an item on the agenda, please complete a Speaker’s Card identifying the item(s) and return it to the Board Clerk. If you wish to speak on a matter that does not appear on the agenda, you may do so during the Public Comment period. Persons speaking during Public Comment will be limited to three minutes, or depending on the number of persons wishing to speak, it may be reduced to allow all members of the public the opportunity to address the Board. Except as otherwise provided by law, no action or discussion shall be taken/conducted on any item not appearing on the agenda. When addressing the Board, please state your name for the record prior to providing your comments. Please address the Board as a whole through the Chair. Comments to individual Supervisors or staff are not permitted.

 

The Board may take action sitting as the Board of Supervisors and as the governing body of:  Siskiyou County Flood Control and Water Conservation District Board, Siskiyou Power Authority, County Service Area 3 Board, County Service Area 4 Board, County Service Area 5 Board, Airport Land Use Commission, and In Home Supportive Services Public Authority.

 

Availability of Public Records. All public records related to an open session item on this agenda, which are not exempt from disclosure pursuant to the California Public Records Act, that are distributed to a majority of the legislative body will be available for public inspection at 510 North Main Street, Yreka CA 96097 at the same time that the public records are distributed or made available to the members of the legislative body. All supporting documentation is available for public review in the office of the Clerk of the Board of Supervisors, located in the Siskiyou County Clerk’s Office, 510 North Main Street, Yreka, CA 96097, during regular business hours, 9:00 a.m. – 12:00 p.m. and 1:00 p.m. - 4:00 p.m., Monday through Friday.

2.            8:30 A.M. - CLOSED SESSION - It is the intent of the Board to meet in closed session to discuss the following items:

A.            Conference with legal counsel, existing litigation pursuant to Government Code §54956.9(d)(1), name of case: Hoopa Valley Tribe v. FERC - Court of Appeals for the District of Columbia Circuit, Docket No. 14-1271.

B.            Conference with legal counsel, anticipated litigation pursuant to Government Code §54956.9, significant exposure to litigation pursuant to Government Code §54956.9(d)(2), one case.

C.           Claimants: Liability Claim Claimant: Donny Daman. Agency claimed against: County of Siskiyou.

D.           Personnel pursuant to Government Code §54957, consider public employee performance evaluation for the position of Director of Health and Human Services.

E.            FLOOD CONTROL AND WATER CONSERVATION DISTRICT - Conference with legal counsel, anticipated litigation pursuant to Government Code §54956.9, significant exposure to litigation pursuant to Government Code §54956.9(d)(2), one case.

5.            10:00 A.M. - CONSENT AGENDA - The following consent agenda items are expected to be routine and non-controversial. They may be acted upon by the Board at one time without discussion. Any Board member, staff member, or interested person may request that an item be removed from the Consent Agenda for discussion and consideration.  Approval of a consent item means approval of the recommended motion as specified on the Agenda Worksheet.

A.            COMMUNITY DEVELOPMENT

Approve request to authorize Personnel to hire Christine Cummings Dawson at Step 4 of the Deputy Director Planning salary range, effective November 19, 2017.

B.            COUNTY ADMINISTRATOR

Approve side letter agreement with the Organized Employees of Siskiyou County Management/Professional Unit re overtime/compensatory time for exempt employees during emergencies.

C.           COUNTY ADMINISTRATOR

Approve request to waive the residency requirement for Interim County Counsel pursuant to Government Code Section 27641.1, effective immediately.

D.           COUNTY ADMINISTRATOR

Approve addendum to contract with VANIR Construction Management, Inc., increasing the contract by $36,730, for a total not to exceed $84,270 and extending the term through November 30, 2018.

E.            HEALTH AND HUMAN SERVICES - BEHAVIORAL HEALTH DIVISION

Approve addendum to contract with Remi Vista, Inc., increasing the contract by $325,000 for a total not to exceed $1,075,000, for an extended term expiring June 30, 2018 and incorporating language as specified in Exhibit A.

F.            HEALTH AND HUMAN SERVICES - BEHAVIORAL HEALTH DIVISION

Approve addendum to contract with Victor Treatment Centers, Inc., to incorporate Fiscal Year 17/18 rates for room and board as identified in the addendum.

G.           HEALTH AND HUMAN SERVICES - BEHAVIORAL HEALTH DIVISION

Approve addendum to contract with Visions of the Cross, Inc., to incorporate rates for sober living services for men, as specified in Exhibit A of the addendum.

H.           HEALTH AND HUMAN SERVICES - BEHAVIORAL HEALTH DIVISION

Approve contract with St. Helena Hospital DBA Adventist Health St. Helena, to provide acute psychiatric inpatient medical services to adult, adolescent and child patients, at the rates identified in Exhibit A, for the term July 1, 2017 through June 30, 2019.

I.              HEALTH AND HUMAN SERVICES - PUBLIC HEALTH DIVISION

Approve request to ratify application and authorize acceptance of the Naloxone Distribution Grant Program award, in the amount of $10,631.25, from the California Department of Public Health for Fiscal Years 2017-2019.

J.            HEALTH AND HUMAN SERVICES - PUBLIC HEALTH DIVISION

Approve request to authorize Personnel to promote Gabrielle Mora to the Correctional Nurse salary range, effective September 10, 2017.

K.            NATURAL RESOURCES

Adopt Resolution to allow Tulelake Irrigation District to apply for a grant for the Tulelake Subbasin under the 2017 Sustainable Groundwater Planning Grant Program.

L.            NATURAL RESOURCES

Approve Memorandum of Understanding with the US Department of the Interior, Bureau of Reclamation for cooperative development of the Shasta Dam Fish Passage Evaluation Environmental Impact Statement (EIS).

M.           PUBLIC WORKS

Approve contract with Cascade Software Systems, Inc., for services related to various computer software modules as identified in the contract, in an amount not to exceed $53,043.18, for the term July 1, 2017 through June 30, 2022.

N.           PUBLIC WORKS

Approve Local Transportation Fund Claim for Fiscal Year 2017/2018, in the amount of 798,679.

O.           SHERIFF-CORONER

Approve Memorandum of Agreement with Butte County pertaining to assistance under the Law Enforcement Mutual Aid Plan for services provided by the Siskiyou County Sheriff’s Office in connection with the Wall Fire from July 7, 2017 through July 10, 2017, in the amount of $1,375.07.

P.            TRANSFER OF FUNDS

1.        Regional Transportation - $57,500. Requires 4/5 Vote.

2.        Community Corrections Partnership - $10,600. Requires 4/5 Vote.

3.        Probation-Youth Offenders Block Grant - $38,000. Requires 4/5 Vote.

4.        Provisions/Court Appointed Counsel - $50,000. Requires 4/5 Vote.

Presentation of an introduction and background regarding the Modoc Tribe of Oklahoma, their recent activities and development of a map outlining the Tribe's homelands.

Discussion and possible direction re update regarding Ore-Cal Resource Conservation and Development Council (RC&D) activities.

Discussion, direction and possible action re first reading of an ordinance retitling Chapter 14 of Title 10 of the Siskiyou County Code regarding the cultivation of cannabis, and amending therein Sections 10-14.010 through 10-14.030, and Section 10-14.060, and deleting Sections 10-14.040, 10-14.050, and 10-14.070, regarding regulation of personal marijuana cultivation in the unincorporated areas of the County.
